1) A 6-9 story, 215-230 apartment building is being proposed for the block surrounding The Col. Brooks Tavern located in 5A07**?

2) The developing team wants to build approximately 215-230 apartment units with ground floor retail and approximately 120-135 below-grade parking spaces? (It is still unknown how many occupants per unit.)

3) The apartment building will be located along Monroe Street, NE between 9th and 10th Streets; down 9th Street NE to Lawrence Street and up back alley of 10th Street, NE to Monroe, Street, NE?

4) The development group seeking approval of this project is called the “901 Monroe Street, LLC.” The 901 Monroe Street members are Jim Steigman, owner of The Colonel Brooks Tavern/Island Jim’s; Bo Menkiti, CEO/The Menkiti Group and Horning Brothers. These three joined together and formed an entity to develop this project?

5) This group intends to file their development application with the DC Zoning Commission ten (10) days from November 5, 2010?

Dear Neighbors: I received this concern this week. - John J. Feeley, Jr.

Dear ANC 5A Commissioners,

I am writing to commissioners who have listed email addresses on the ANC 5A website regarding what I perceive to be the poor condition of the Charles Drew bridge. Every time I have to drive over it, I feel concerned. One rainy Sunday in September I sent an email to councilmembers who have any oversight connection to transportation, to the Council Transportation chief of staff and to DOT Director Klein.

Here is the email that I sent:

"I am writing about the condition of the Charles Drew Bridge on Michigan Avenue, NE, over the railroad and Metro tracks. The bridge does not look to be in good condition, and I feel concerned about its safety. Had we not seen the collapse of other bridges around the country, I might not be alarmed. However, I know that many of us who go across that bridge frequently would welcome its repair and strengthening.

In the last couple of weeks we've seen sidewalk work in our neighborhood that almost looks like makework. At the same time, to my knowledge, no serious attention has been given to the well-traveled Drew Bridge. Repairing that bridge would respect the memory of Dr. Drew and improve safety for citizens who cross the bridge. President Obama recently announced support for infrastructure projects. The repair of the Drew bridge is an infrastructure project calling for attention in our long under-served neighborhood.

I and many neighbors request that you who have an oversight connection to transportation and infrastructure please inspect the bridge for its safety conditions and, hopefully, prioritize it for upgrading. I welcome any responses you have.

Thank you for your consideration."

I received a reply from Director Klein that evening stating: "I am not aware of safety issues or any structural concerns with this bridge. Having said that, let's get the latest rating information from our bridge team so we all know the latest assessment. We look at all bridges every 2 years btw." Terry Bellamy of DOT followed up with this: "I am asking our SBM team to investigate and make necessary cleaning. I am also directing our Bridge Engineer for a structural rating update on the structure."

Councilmember Thomas wrote that he "would continue to follow up with the director re these concerns." I was copied on an email from Councilmember Catania to Director Klein asking to be kept informed about the bridge. A month or so has passed since I first contacted them, and I want to follow up. As I was thinking about it, it occurred to me that you ANC commissioners ought to be informed of my exchange and the fact that some of my Ward 5 friends and neighbors are concerned about the bridge.

I had occasion to run into Charlene Drew Jarvis, and I told her about our concerns and contacts with councilmembers and DOT, and she said she would follow up.

I hope that some of you and your constituents share concern about the Drew bridge, and I'd be happy to follow up with any of you.

DDOT Presents Updated DC Streetcar Plan

Plan Submitted For Council Review and Approval

(Washington, D.C.) The District Department of Transportation (DDOT) has presented an updated comprehensive DC Streetcar System Plan to the DC Council for review and approval. The plan details DDOT's plans for the design, construction and operation of the system and covers topics such as operations, safety, fare collection, and funding.

The document specifies how DDOT plans to complete the two streetcar lines already under construction, the H Street/Benning Rd Line and the Anacostia Initial Line Segment, and lays out the plans for additional extensions in Wards 7 and 8. It also includes the completed DC Transit Future System Plan – the District’s first comprehensive streetcar system plan. DDOT is planning a 37-mile, 8-line streetcar system with service across the city.

The highlights of the plan include:

· DDOT will initiate streetcar operations in spring 2012

· The DC Streetcar will create 200 permanent jobs at the onset of service and up to 700 upon completion of the entire system

· DDOT is currently pursuing $110M in federal funds to pay for two streetcar extensions East of the River

· Details on how DDOT will resolve issues with the power supply; DC Streetcar will utilize overhead wires on the first two lines and move to wireless operation as the system expands

· A framework to develop a financial plan and governance structure for the entire system

The plan was transmitted by the Mayor last week and formally introduced today by the Chairman of the DC Council on behalf of the Mayor in accordance with the requirements laid out in the Fiscal Year 2011 Budget Support Act. Approval of the DC Streetcar Plan by the DC Council will release $34.5 million in capital funding for the current H/Benning streetcar project.

Area activities cause temporary rerouting from Oct. 22-24

Metrobuses will detour from several routes Friday to Sunday, Oct. 22-24, in the District of Columbia, and Alexandria and Arlington, Va., due to various events.

The following routes will be affected by detours this weekend:

Friday
Routes 32, 36, P2 and P6 will detour from 8 p.m. on Friday to 6 a.m. on Monday around Fourth Street, NW/SW, between Constitution and Independence avenues in the District of Columbia due to the USA Science and Engineering Festival Expo.

Saturday
Routes 13F, 13G, 32, 34, 36, 52, 54, 64, 70, 70/, P6, S2, S4 and V8 will detour from 7:30 to 10:30 a.m. for the Best Buddies Special Olympics Challenge in the District of Columbia. The following streets will be closed:

• Constitution Avenue, NW, between Third and 17th streets, including crossing streets
• 12th Street, NW, between Constitution and Pennsylvania avenues
• Pennsylvania Avenue, NW, between Third and 12th streets, including crossing streets

New Mobile Radar Locations Deployed Citywide

(Washington, DC) – Metropolitan Police Department (MPD) announced today the deployment of six new photo enforced mobile radar locations beginning Friday, February 12, 2010.

“On the heels of two years in a row of record low traffic fatalities in the city, we intend to continue our commitment to public safety through the use of technology,” said Police Chief Cathy L. Lanier.

The deployment locations for the Mobile Radar Units will continue to be at sites with the highest number of crashes and injuries, calls for police service, and high speed volume. MPD also considered recommendations or requests from the Department of Transportation, Advisory Neighborhood Commissions and civic or citizen associations.

The thirty day educational phase will commence on February 12, 2010 where as violators will receive warning citations. On March 13, 2010, MPD will begin issuing live citations to violating motorists.

The new locations are as follows:
· 1800 block of C Street NE
· 3500 block of Massachusetts Avenue NW
· 5800 block of New Hampshire Avenue NE
· 5900 block of New Hampshire Avenue NE
· 300 block of Rock Creek Church Road NW

Here are some points made at the 5A06 Single member district meeting:

1. Liquor license issues: Brookland Cafe is now applying for a restaurant license not a tavern license. There is still a protest from residents at Oak Terrace principally, and I have once again joined these constituents in their protest. Their objective is to enter into a voluntary agreement with Mr. Lumukanda, the proprietor.

2. Zoning: In the contiguous smd, in 5C, Abdo Development proposes a planned unit development and presented said pud to the zoning commission on October 5. Much support from the Commission but some concern on their part for the neighbors on Lawrence who came out in opposition. This response should embolden and mobilize residents of 5A06 for the day that Jemal and Metro come forward with their plans.

3. Fort Bunker Hill Park - The commissioner is talking to Park Service officials and the Friends of the Park about a clean up in the spring.

4. Neighborhood parking stickers for Turkey Thicket: There was some skepticism about the effectiveness of neighborhood stickers. It was suggested that what is needed is enforcement.

5.Jemal property/Tenleytown Trash: No response from the owner of Tenleytown about relocating trucks to another part of the facility, not next to residents on Perry Place.

6. Michigan Avenue Traffic Calming petition: This petition, which addresses enforcement (speed cameras) and flashing pedestrian crossing signs for Michigan Avenue between 10th and 12th, is being circulated.

7. Brookland School maintenance - School back parking lot has been cleaned, the grass cut and the gates locked.

8. It was pointed out that DDOT is not cutting the grass beside the bridge across from Comcast. - J. Feeley, 5A06

Cardinal's Nest decision

Dear Neighbors: To all who have not heard as of yet: the Liquor Control Board found against the Cardinal's Nest in a May 13 decision. They found the establishment at fault for serving liquor to minors, allowing alcohol to be taken out of the establishment, for violations of the voluntary agreement with the community, noise violations and not displaying the voluntary agreement. The penalty was a $5,000 fine and a 15 consecutive day suspension, from June 17th to July 1, 2009. This is what the assistant attorney general's office was requesting, short of revocation of their license. - John Feeley

Thomas Announces Median Strip on 12th Street Will Be Limited to Painted Street Markings

Washington, DC-

Ward 5 Councilmember Harry "Tommy" Thomas, Jr. announced today that the District Department of Transportation (DDOT) has reversed its decision to install a landscaped, 10-foot wide median strip on 12th Street between Randolph and Perry Streets, NE. Councilmember Thomas, who received complaints from Brookland residents and businesses about the proposed median, met with DDOT planning staff in January 2009. At the January meeting, DDOT agreed to postpone installation of a landscaped median until further engineering studies were completed and the other potential traffic calming measures were assessed. After completing its analyses, DDOT determined that the best choice is the use of painted street markings to delineate a median strip. The option of a re-striping 12th Street to provide a 10-foot wide median between Randolph and Perry Streets, NE is one of the potential traffic calming solutions included in the Brookland Multi-Modal Transportation and Streetscape Study (on page 115)..

"A landscaped, 10-foot wide median on 12th Street would have constricted access to some of our neighborhood businesses along the corridor" said Councilmember Thomas. "In today's uncertain economy, constricting access could be the death knell to a small business. Not only is this a victory for Brookland, but also for all neighborhoods across the city trying to nurture their local business districts." ###

Harry "Tommy" Thomas, Jr. represents Ward 5 on the Council of the District of Columbia. Thomas chairs the Council's Committee on Libraries, Parks, and Recreation. He sits on four additional committees: Workforce Development and the Environment, Aging and Community Affairs, Housing and Workforce Development, and Public Services and Consumer Affairs.

Commission vote on the Cardinal's Nest resolution

Commission 5A voted 9 to 2 against the following resolution concerning the Cardinal's Nest Show Cause Hearing:

Resolution concerning the Cardinal’s Nest Show Cause Hearing, 3/2/09

WHEREAS, the Office of the Attorney General has brought charges against the Cardinal's Nest alleging a variety of violations, including: (1) amplified sound and music penetrating into residential areas and even individual homes; (2) serving underage and inebriated patrons; (3) failing to honor the voluntary agreement; WHEREAS, the ABC Board has scheduled a show cause hearing on the charges; WHEREAS, the ABC Board has referred other charges which the Office of the Attorney General may bring in the future; RESOLVED, due to the breadth and variety of the charges the Office of the Attorney General has brought, if the ABC Board sustains the majority of them, ANC 5A requests the ABC Board revoke Cardinal's Nest's license.

Brookland Small Area Plan Moves Forward:
Thomas Requests Inclusion of Specific Recommendations in Approval Resolution

Washington, DC—Ward 5 Councilmember Harry “Tommy” Thomas, Jr. announced that PR
18-46, the “Brookland/CUA Metro Station Small Area Plan Approval Resolution of 2009,
was approved by the City Council at its March 3, 2009 legislative session. Councilmember
Thomas thanked Chairman Vincent Gray for his extraordinary leadership in shepherding the
resolution forward. Thomas also praised the DC Office of Planning for its efforts to create a
plan that promoted transit-oriented development as well as preservation of green space.
Thomas requested removal of the resolution from the Council’s Consent Agenda so that
comments and concerns about the plan could be raised and discussed. In particular, Thomas
wanted to ensure that the voice of ANC 5A was heard, and that its three areas of concern
were addressed: 1) completion of a comprehensive transportation study, 2) reassessment of
the "decking" and "fill" alternatives, and 3) incorporation into the plan community viewpoints
regarding the preservation of the Brookland Green, excessive density, and preservation of the
neighborhood’s character.
In response to community concerns, Thomas requested that the Council’s approval resolution
for the plan instruct the Office of Planning to:
• Add a notation in the plan that the District Department of Transportation intends to
update the District's transportation model and apply that new model to the Northeast
quadrant; and that OP and DDOT report back to the community on the results of the
model's application to the Northeast quadrant.
• Emphasize the option of open space along 10th Street at the Metro station by including it
as an example under the Small Area Plan Urban Design Concepts Summary.
• Emphasize its intent to work with community residents and ANCs to address design and
scale issues of proposed developments through the planned unit development process.
• Clarify how neighborhood character is protected through the vision and framework of the
plan.
“The Brookland/CUA Metro Station Small Area Plan is the result of tremendous citizen input and
collaboration with Office of Planning staff,” said Thomas. “The plan’s approval will enable
development in this important Ward 5 neighborhood to proceed with a guiding framework in
place.”

In view of the upcoming City Council vote on Tuesday, 3/3/09, and the fact that there has been no move from the Office of Planning to meet with the Commissioners of 5A to make specific changes to the Brookland/CUA Metro Small Area Plan, I must recommend to everyone in Brookland and Michigan Park contact the members of the City Council expressing opposition to the this Small Area Plan. E-mail or call all of the Council to say,"Vote No on the Brookland/CUA Metro Small Area Plan." Councilman's Development Expo

After Saturday's (2/28/09) Ward Five economic summit, Councilmember Thomas met w/ four dozen area residents and interested property owners for 2 hrs re OP's small area plan for the Brookland Metro Station. The plan is to be acted on this Tuesday b/c, unless it is revised or rejected by Tuesday, it takes effect automatically.
This bit of news took the affected ANC Commissioners in the room (Feeley, Steptoe, Blair, Daly from 5C) by surprise b/c they felt Council chairman Gray had committed to having OP meet w/ ANC 5A beforehand. Steptoe, however, felt that Tregoning had half-heartedly agreed to meet but felt such a meeting would not persuade OP to make any substantive changes. Nevertheless, the meeting had not taken place and could not take place by Tuesday. Councilmember Thomas insisted his ad hoc meeting was intended to fulfill Chairman Gray's objective, but the ANC Commissioners present objected to this end run around the great weight to which ANCs are entitled as disrespectful of the ANCs not then formally assembled or quorumed to make any decisions.

Advisory Neighborhood Commission 5A

Last night, 2/6/09, at the 5A Committee of the Whole meeting, my fellow commissioners weighed in on my Cardinal's Nest resolution. In this resolution I listed the violations of the law observed by ABRA investigators and the violations of the voluntary community agreement. My resolution supported the revocation of the Cardinal's Nest's liquor license. The Chair of 5A, Ms. Alston, and several other commissioners expressed concern that they had not heard from representatives of the Cardinal's Nest. Ms. Olsen, a manager at the establishment, Mrs. Green, the owner, two other employees, and several patrons spoke in defense of the Cardinal's Nest. About 25 people came in support of the Cardinal's Nest. They were given 15 minutes to speak. Craig Parker, legal counsel for Catholic University, and Dino Drudi, one of the signers of the voluntary agreement, spoke in support of the resolution. Each commissioner then spoke concerning the resolution. All but two spoke in direct opposition to the resolution. They cited concern about effectively closing a business in the ward. Commissioner Grant suggested that after I had conducted some mediation between the community and the management of the Cardinal's Nest, I might submit another resolution to the Commission. I withdrew my resolution in the face of such clear opposition from the majority of the Commission and intend to amend it and reintroduce it at the next 5A Committee of the Whole meeting, which will be March 2, 2009 at 6:30. This is a reminder about tomorrow's court hearing regarding undergrounding the overhead wires on 12th Street. Please note that the Courtroom is 516 (not 316 as we were previously informed) and the presiding judge is Judge Retchin.

It is an important event: the Judge will be deciding whether to grant an injunction against DDOT for failing to obey the law passed by the DC Council and the Mayor requiring DDOT to bury the power lines on 12th Street with the remaining funds for the project. Live testimony will be presented by both sides at the hearing. If you can make it, that would be great!

Tonight at the 5A Commission meeting, I proposed the following resolution to the Committee of the Whole: Proposed Resolution concerning ABRA and the Cardinal’s Nest:

Whereas the Alcoholic Beverage Regulation Administration has charged Brookland Restaurant Inc. t/a the Cardinal’s Nest with five violations of the alcoholic beverage regulation code, including serving alcohol to persons under the legal age, selling liquor not for consumption within the said establishment, and permitting the sale of side drinks on two separate dates, 3/28/08 and 8/28/08, and

Whereas the Brookland Restaurant Inc. t/a the Cardinal’s Nest has broken provisions of their voluntary agreement with residential neighbors in nine instances as observed by ABRA investigators on three different dates, 3/28/08, 5/17/08, on 6/22/08, and

Whereas the residents of 5A06 voted 18 to one in support of revocation of the Cardinal’s Nests ‘s license at a single member district meeting on 1/12/08,We, the Advisory Neighborhood Commission for 5A, support the revocation of the liquor license of said Brookland Restaurant Inc. t/a the Cardinal’s Nest on January 28, 2008.

This resolution was tabled and will be considered at the Committee of the Whole meeting to be held at the Committee of the Whole meeting on Thursday, February 5, at 6:30 at the Turkey Thicket Recreation Center. The Judge's chambers called at the end of the day yesterday, 1/27/09, to say that Thursday's court hearing concerning DDOT and use of funds for undergrounding has been rescheduled to WEDNESDAY, FEBRUARY 4TH at 10AM.
